Terms of Service

These Terms govern your use of Spark Short Drama, a short-form drama service made available as a TikTok Mini in the United States.

1. Operator and acceptance

The Service is operated by Hainan Xinghuo Zhihua Culture Technology Co., Ltd. (“Sparkart,” “we,” “us,” or “our”), Unified Social Credit Code 91460000MAK9D7F4XH. By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old and legally permitted to use TikTok and the Service in the United States. The Service is not directed to children under 13. If you are under the age of legal majority where you live, your parent or legal guardian must review these Terms and authorize your use of any paid feature. You represent that the information used to access the Service is accurate and that you are not prohibited from receiving the Service under applicable law.

3. TikTok account and platform

The Service runs within TikTok and relies on TikTok for authentication, reporting, Beans, payment, and other platform capabilities. Your TikTok account and use of those capabilities remain subject to TikTok's own terms, policies, and community guidelines. Sparkart and TikTok are separate entities; neither party's terms change the other party's independent obligations to you.

3A. Account and session security

You are responsible for maintaining the security of your TikTok account and device and for activity performed through them to the extent permitted by law. Do not share TikTok verification codes, Spark session values, or payment credentials. Notify TikTok immediately of suspected account compromise and notify us if it affects Spark orders or access. We may end sessions, require reconnection, or temporarily restrict access when reasonably necessary to address fraud, credential compromise, revocation, or security risk.

4. The Service

The Service lets users discover and watch licensed short-form drama content. Availability may vary by state, title, device, TikTok version, rights window, platform review status, maintenance, or legal requirement. We may add, modify, suspend, or discontinue content or features. If a change affects paid access, we will provide any remedy required by applicable law or platform policy.

4A. Content ratings and viewer discretion

Drama content may contain fictional violence, romantic or sexual themes, strong language, substance use, flashing images, or other mature subject matter. Ratings, labels, synopses, and warnings are informational and do not replace a parent or guardian's judgment. Stop playback if content causes discomfort or a photosensitive reaction. Report a materially inaccurate rating or missing warning through Content and Safety Reporting.

5. TikTok Beans, orders, and episode access

Some episodes may require a one-time unlock using TikTok Beans. Before you confirm, the Service displays the episode and applicable Bean amount. TikTok or its payment partners process the acquisition and use of Beans under their own terms; we do not receive your card or bank credentials.

A completed unlock grants a limited, personal, non-transferable right to stream the identified episode through the Service while it remains lawfully available. It does not transfer ownership, have cash value, or permit transfer or resale. Bean balances, billing, reversals, and refunds are subject to TikTok's policies and applicable law. If payment completes but access is not delivered, contact Support with the non-sensitive order reference. Nothing in these Terms limits refund, chargeback, cancellation, or other rights that cannot lawfully be waived.

The current Service offers one-time episode unlocks and does not offer an automatically renewing Spark subscription. We will clearly disclose price, billing period, renewal, cancellation, and trial terms before introducing any subscription or recurring charge, and we will obtain any consent required by applicable law and TikTok policy.

6. Content and intellectual property

We and our licensors retain all rights in the Service, drama titles, video, artwork, text, software, trademarks, and related materials. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access available content through the Service for private, non-commercial viewing. You may not copy, record, download, redistribute, publicly perform, sell, scrape, reverse engineer, bypass access or payment controls, remove rights notices, or use the content outside the Service, except as expressly permitted by law.

7. Acceptable use

You must not interfere with the Service; attempt unauthorized access; introduce malicious code; use bots or automated extraction tools; evade geographic, content, security, or payment restrictions; infringe another person's rights; submit knowingly false reports; impersonate another person; or use the Service for unlawful, fraudulent, abusive, or harmful activity.

8. Reports and copyright complaints

You may report safety, privacy, or other concerns through Report content and intellectual-property concerns through our Copyright and IP Complaints process. TikTok's in-product reporting tools may also apply. We may restrict content while reviewing a report and may provide information to TikTok, rights holders, or authorities when permitted or required by law.

9. Suspension and termination

We may restrict or terminate access when reasonably necessary to protect users, rights holders, TikTok, the Service, or legal compliance, including for a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to address the issue. You may stop using the Service at any time and may disconnect and request deletion as described on our Account Disconnection and Data Deletion page.

10. Privacy

Our Privacy Policy explains the information we process, how it is used and disclosed, retention, international processing, and your privacy choices. Please review it before using the Service.

11. Third-party services and links

TikTok, BytePlus, content-delivery networks, and other providers support the Service and may apply their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control. This section does not limit our responsibility for selecting and overseeing service providers or any responsibility imposed on us by law.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free availability, continued availability of any title, or compatibility with every device or TikTok version. Nothing in these Terms excludes warranties, remedies, or other protections that applicable consumer law does not permit us to exclude.

13. Limitation of liability

To the maximum extent permitted by law, Sparkart and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service. These limitations do not apply to liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, gross negligence, or personal injury where applicable law so provides.

14. Governing law and disputes

These Terms and any dispute arising out of or relating to the Service are governed by the laws of the Commonwealth of Virginia and applicable federal law of the United States, without regard to conflict-of-law rules. This choice reflects that the Service is offered to users in the United States and its principal U.S. application infrastructure and performance are located in Virginia. It is not intended to deprive you of any non-waivable consumer protection available under the law of the state where you live.

Before filing a claim, please contact us and allow 30 days for a good-faith attempt to resolve it. Either party may then bring an individual claim in a state or federal court with lawful jurisdiction. You may bring an eligible claim in small-claims court, and you may bring proceedings in your home state when applicable law gives you that right. These Terms do not require arbitration and do not waive any right to participate in a class or representative action that applicable law gives you.

15. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, or platform requirements. We will post the revised Terms, update the date above, and provide additional advance notice of material changes when required. Changes apply prospectively; continued use after the effective date constitutes acceptance only to the extent permitted by law.

16. General provisions

If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, sale of assets, or by operation of law, subject to applicable notice requirements. These Terms, together with the policies linked here, are the entire agreement between you and Sparkart concerning the Service.

17. Electronic communications and notices

You consent to receive transaction, security, support, and legal notices electronically through the Service, TikTok, the email address you choose to provide, or publication on this legal site, to the extent permitted by law. You are responsible for keeping any voluntarily supplied contact information current. Electronic consent does not require you to receive marketing messages, and we do not currently send Spark marketing email.

18. Feedback and communications

If you send feedback or suggestions, you permit us to use them without restriction or compensation, but you retain ownership of any copyright you hold in your original communication. Do not submit confidential information, content you do not have authority to provide, or unnecessary personal information. Reports, legal notices, and privacy requests are governed by their specific procedures and are not treated as unrestricted feedback.

19. Export controls and sanctions

You may not use, export, re-export, transfer, or provide the Service in violation of applicable United States export-control, sanctions, or trade laws. You represent that you are not prohibited from receiving the Service under applicable law. We may restrict access where reasonably necessary to comply with a binding legal restriction, while preserving any non-waivable consumer rights.

20. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as widespread network or cloud outages, natural disasters, war, civil disorder, governmental action, labor disruption, platform suspension, or failure of a third-party service, except to the extent applicable law assigns responsibility or requires a refund or other remedy. We will use commercially reasonable efforts to reduce disruption and restore the Service.

21. California consumer notice

California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at 800-952-5210 or 800-735-2929 (TTY). This notice does not limit the dispute rights in Section 14.

22. Survival

Provisions that by their nature should continue after termination—including ownership, payment records, permitted legal disclosures, disclaimers, liability limitations, dispute terms, and general provisions—survive termination to the extent enforceable. Termination does not eliminate rights or liabilities that accrued before termination.
