Terms of Service

These Terms govern your use of Spark Short Drama, a short-form drama service made available as a TikTok Mini.

1. Operator and agreement

The Service is operated by Hainan Xinghuo Zhihua Culture Technology Co., Ltd. (“Sparkart,” “we,” “us,” or “our”), Unified Social Credit Code 91460000MAK9D7F4XH. By accessing the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and TikTok account

You must be at least 13 years old and legally permitted to use TikTok and the Service in your location. If you are under the age of legal majority, you may use paid features only with permission from a parent or legal guardian where required. Access relies on your TikTok account and remains subject to TikTok's applicable terms, policies, and community guidelines.

3. The Service

The Service lets users discover and watch licensed short-form drama content. Availability may vary by region, title, device, TikTok version, rights window, platform review status, maintenance, or legal requirements. We may modify or discontinue features, but changes do not reduce rights that cannot lawfully be waived.

4. License and intellectual property

We and our licensors retain all rights in the Service, drama titles, video, artwork, text, software, trademarks, and related materials. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access available content through the Service for non-commercial viewing. You may not copy, redistribute, publicly perform, sell, scrape, reverse engineer, bypass access or payment controls, remove rights notices, or use content outside the Service except as permitted by law.

5. TikTok Beans and episode access

Some episodes may require a one-time unlock using TikTok Beans. TikTok or its payment partners process the acquisition and use of Beans under their own terms. Before confirmation, the Service displays the applicable Bean amount. An unlock grants personal access to the identified episode while it remains lawfully available; it does not transfer ownership, grant cash value, or permit transfer or resale.

Payment processing, Bean balances, refunds, reversals, and platform billing are also subject to TikTok's policies and applicable law. If a completed payment is not reflected, contact us through Support and include the non-sensitive order information requested there. Do not send payment credentials.

6. Acceptable use

You must not misuse the Service; interfere with its operation; attempt unauthorized access; use automated extraction tools; evade geographic, content, security, or payment restrictions; infringe another person's rights; submit false reports; or use the Service for unlawful, fraudulent, abusive, or harmful activity.

7. Suspension and termination

We may restrict or terminate access when reasonably necessary to protect users, rights holders, TikTok, the Service, or legal compliance, including for a material breach of these Terms. You may stop using the Service at any time and may disconnect and request deletion as described on our Account Disconnection and Data Deletion page.

8. Third-party services

TikTok hosts the Mini environment and provides authentication, reporting, and payment capabilities. BytePlus and its delivery network support approved video playback. Those services may have separate terms and privacy practices. We are not responsible for third-party services outside our reasonable control, but this does not limit any responsibility imposed on us by law.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, continued availability of any title, or compatibility with every device or TikTok version. Nothing in these Terms excludes warranties or remedies that applicable consumer law does not permit us to exclude.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from the Service. This limitation does not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law so provides.

11. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. This choice does not deprive you of mandatory consumer protections or other non-waivable rights available under the law of your place of residence.

Before filing a claim, please contact us and allow 30 days for good-faith resolution. If a dispute cannot be resolved, it may be submitted to a court with competent jurisdiction at the operator's domicile, except where mandatory applicable law gives you the right to bring proceedings in another forum.

12. Changes

We may update these Terms to reflect changes in the Service, law, or platform requirements. We will update the date above and provide additional notice when required. Changes apply prospectively unless law requires otherwise.
